Automated transcript · uncorrectedSunday Morning with us is Alan Deshowitz, and he is the constitutional lawyer for the whole country in Harvard Law School emeritus and he was there for over sixty years. Professorshowitz, Sunday Morning, it’s time to think, think things out. Tell us about the appointments that President Trump is making. And he’s getting a lot of criticism for for gets, and
nobody can figure out why he’s doing it.
You have any input, well, I was asked for my advice about who the name is attorney general, and I certainly didn’t have Gets on my short list or long list. President Trump has made some great appointments. I love some of his appointments. I think State Department is a great appointment, Ambassador to Israel is a great appointment. There are so
many good appointments. But I think he has made it more difficult for Republican senators by appointing Getz, who just doesn’t seem to have the qualifications that have been traditionally associated with attorney general. I don’t think he’s going to get fifty Senators to vote to confirm, and so I think what he’s going to try to do is get
a recess appointment, and that will be challenged in the Supreme Court, and there’s an opinion by Justice Scalia, who is the god of the Conservatives, saying no, you can’t use recess appointments to circumvent the constitutional requirement that the Senate confirmed nominees like the attorney general. So you know, I wish he would withdraw that nomination and nominate somebody
who is a consensus candidate, somebody who could be.
Professor. The congressman already resigned from Congress. I guess the rumor was that the Congressional Committee was after him.
It was that they were about to issue a report, and I think he was looking for a way to resign from Congress without somehow admitting his guilt or seeming to admit his guilt. So this was a neat exit route from Congress. So I don’t think that President Trump owes gets anything, And if he wants to withdraw the
nomination now, I think gets is happy that he’s no longer in Congress, because that means the report the committee investigating him has no jurisdiction. And if he’s no longer nominated, then they won’t be Senate confirmation hearings and they won’t be able to get to what was in the report.
If there is a Senate confirmation hearing, the first thing the Senate will do would be subpoena the House report on Gets and see what it actually says about him. So it would be a mess, and it would really everted attention from President Trump’s policies which he wants to implement.
And he shouldn’t allow one appointment to get in the way of serving what he believes as a mandate from the American public. The American public did not give him a mandate to appoint somebody like Gets. I think if you did a poll, you’d find that that appointment was very unpopular, even among Republicans and even among people who
voted for President Trump.
I think you’re more right than wrong, and I agree with what you’re saying. Any other appointments you have any difficulties with.
I think there have been some difficulties by some people with Tulsea Gabbett, but I don’t know enough about her to I think that would have gone through if not Forgets. I think Gets has endangered some of the more controversial appointments, but I think generally his appointments have been quite good, and they would have all gotten through Gets. I don’t
know who recommended to him that he nominate Gets. He was not on the list that I was seeing, because I was asked for my advice on who should be Attorney General, and I saw a number of lists. His name was not on any of those lists.
Understood now, could it be just that they made a deal just to get out of Congress for a good exit strategy.
It’s possible, and it gives Trump a chance to flex. There’s muscles test the atmosphere out there. But if it was a test, the test has failed a lot of Republican senators are not happy.
Now he’s President. Trump supported the Rick Scott for a majority leader. Does that mean that the majority leader now, who not yet accepted, will hold a grudge against Trump.
I don’t think so. I don’t think so. I do think that. I’m sure the new majority little wishes that his first job was not to justify the Casts nomination. But he’s already said that he would favor in trom appointment. So, and the question is whether the courts would uphold interim appointment.
It’s a very hard question because the Supreme Court generally doesn’t like to get into the business of regulating the Senate. But when you have a situation where it’s in the Constitution, I can imagine a Supreme Court majority saying, no, you’ve gone You’ve gone too far. This is a fight that Trump didn’t need. He was doing so well. It’s a
self inflicted wound. But it’s not a wound yet because he hasn’t officially made the nomination, and he can say, look, I didn’t realize there’d be so much opposition to this. I want to bring people together, and so I’m going to change my mind, and I’m going to nominate Mike Lee, Senator from Utah, to be the Attorney General. Everybody would
approve of that. I understood he would be a very tough and good nominee. Is somebody like that, understand?
And I agree with you. Now give us you the pulse of the reaction of the Europeans that basically didn’t just about all of them were supporting Harris. Are they calling up and apologizing or calling up and saying, oh, well, you know, congratulations.
I think they’re doing a little of both. I think they’re calling up to try to make friends, and that’s the right thing to do. Obviously, a Preme Minister doesn’t have to do that, because although Nataniel didn’t state any position on the election, I think everybody understood that he probably he is not unhappy with the election of Trump,
with the appointment of Mike Kackavie, with the appointment of some other people. So he’s not making any He made I think two or three calls immediately just congratulating him. But I think we’re seeing a lot of problems in Europe.
Look manifested by what happened in Amsterdam and what’s possibly going to happen in Paris with anti Semitism. We’re seeing a tremendous amount of anti Americanism, anti Semitism. We’re seeing tremendous influence in some countries of Muslim and Arab minorities that are being part of this anti Semitic and anti American violence. And so, you know, Europe has its own
problems and they’re not happy with Trump, but he’s going to be the leader of the free world for the next four years and they better come to.
Terms of I understand that Macron is not happy with with a president Trump, and that he feels that he wants to continue to support the Ukraine that Trump might not be and also the head of the Europe also the head of NATO. What is his name, thun.
Well. I can tell you I’m not happy with Micran either. I don’t think he’s been a particularly good leader. I’m not happy with the leader of Great Britain. There’s a lot of unhappiness and uh, you know, they have to come to grips with it. We don’t know what the situation is gonna be in Ukraine. Probably there’s gonna be
an effort to try to come to some compromise to end the war. And you know, it’s in the nature of compromises. You know, you’ve been an incredibly successful businessman. Compromises usually don’t make either side completely happy.
And it’s the by the way, I made a mistake. It’s NATO head route are you t Te and Francis McCrone announced together notwithstanding what Trump does about the Ukraine, NATO will continue to support the Ukraine. I guess it is what it is.
Yeah, Look, NATO without the United States is not NATO. Yes, so it needs American support, both financial and military support. So this is going to be another area of conflict in the world. American support for NATO. Look, the election of Trump shakes up the world, and that’s what he wanted.
And I think the American public voted for a shakeup. Now, how much he shakes it up, and whether he does it all at once or does it gradually, it remains to be seen. But we’re in for an interesting four years, that’s for sure.
Thank you so much, Professor Deshowitz. And let’s keep praying for not only off country, let’s keep praying for the world.
Absolutely, thank you so much.
